Complaint over second bin

Fears that councils will be unable to restrict how much household waste they collect are unfounded, the government has said.

Concern grew following a Local Government Ombudsman ruling that Congleton BC should give a second wheelie bin to a householder.

Although the ruling was non-binding, it was feared it would lead to more resident appeals.

However, a Department for Environment, Food & Rural Affairs spokeswoman said the Climate Change Bill would reinforce powers allowing councils to refuse to collect rubbish deposited in breach of their requirements.

Congleton monitoring officer Peter Sutton said the eventual offer of a second bin was not an admission that the council's policy was illegal.
