The Business Services Association has urged the new government to end the uncertainty of the Transfer of Undertakings Protection of Employment regulations.

Writing in the Municipal Journal (p3) BSA director Norman Rose expressed concern that, if in the wake of recent judgments of the European Court of Justice, it is no longer clear how contracts will be offered for tender, tendered or let.

He believes the Szen and Betts judgements regarding TUPE have led to more caution amongst local authorities and contractors and have not encouraged outsourcing of contracts.

Mr Rose considers that the new government should take the opportunity to clarify the legal situation if it wants to ensure value for money.
