A judge has given leave to challenge Solihull MBC's decision in November to reject a boy's appeal against his permanent exclusion from a secondary school.

The judge said that the 12 year old boy, who was excluded for allegedly threatening another pupil with a knife, had 'an arguable case' that the council's education appeals committee had not fully considered a proposal that the boy receive interim tuition at the social services department's education unit before being gradually integrated into the school.

A spokesman for Solihull MBC said: 'We have not been served with any papers and until we have we cannot comment.'
