Parks and gardens maintenance company Brophy is fighting to ensure that 27 former employees do not lose up to £60 per week as a result of Devon CC regaining a contract to maintain school grounds, reported the Financial Times (7 Jan, p7).

Brophy, which lost the contract after five years to the Liberal Democrat-controlled council's direct services arm, said the conditions being offered to its former employees were worse than those they had enjoyed and which are guaranteed under the Transfer of Undertakings (Protection of Employment) Regulations (Tupe).

Devon Direct Services said negotiations are in progress to increase staff's basic pay by a substantial amount and 'other matters' are being discussed, the paper reported.
