Following the outcome of an Employment Tribunal on Friday 8 September which decided that a requirement for Heads to work full-time can be unlawful discrimination (see LGCnet), a Devon Education spokesperson said:

'Devon County Council is naturally disappointed.

'The Headteacher of Langtree Primary School expressed a wish to return on a job share basis following maternity leave. The tribunal indicated that the Governing Body should have not only considered job share arrangements but options for part-time working.

'We are now awaiting the full written judgement before deciding how to proceed but are required to consult with Mrs Marshall within 28 days.

'The County Council is surprised that the NAHT wishes to argue that the functions of a headteacher can be carried out part-time. This seems to counter any campaign to acknowledge the stress on Headteachers by arguing in effect that the job can be done part-time.

'Devon County Council has also emphasised the importance of a full-time substantive Headteacher in moving a school out of serious weaknesses into which category Langtree Primary was placed following its Ofsted inspection in January 2000'.
