The Guardian (p6) reports that the European court of justice is to rule on whether the government's 'habitual residence test' for benefit entitlement breaches European law.

The ruling is being sought by a social security commissioner John Mesher.

He is following up the case of Robin Swaddling, a communications professional who failed the residence test on his return to Britain after working in France.
