A nine year old gifted girl has won the first stage of a high court battle to force Camden LBC to pay her £4,300 a year school fees, the Independent reports (p7).

The girl unusually has an IQ in the top 0.02% of the population combined with learning difficulties, but Camden has refused to pay fees for a specialised private school because it argues it has no statutory duty to do so.

Education Secretary John Patten has refused to overturn Camden's decision.

Yesterday the girl was given leave for judicial review of her case against the council and Mr Patten. The case is expected to come to court later this year.
