The Health and Safety Executive is prosecuting Camden LBC for alleged breaches of health and safety legislation.

The prosecution follows an investigation by HSE after sections of over 150 flues from gas fires in flats on the College Place Estate, London NW1, were found to be disconnected.

The HSE also investigated the local authority's management of gas safety for its tenants at this and other estates.

It is alleged that London Borough of Camden failed to discharge a duty under Section 3(1) of the Health and Safety at Work etc Act 1974 in that they failed to ensure the safety of their tenants at the College Place Estate when it was refurbished and re-roofed in 1993.

It is further alleged that London Borough of Camden contravened regulations 35(3)(a) and 35(3)(b) of the Gas Safety (Installation and Use) Regulations 1994 in that they failed to carry out and keep records of gas safety checks of gas appliances for which they were responsible at the Kilburn Vale Estate, NW6 and the Kingsland Estate, NW8.

A total of 18 charges are being brought under these regulations. The cases are due to be heard at Clerkenwell Magistrates Court on 21 November.
