Lancashire CC was last week granted leave to launch a judicial review of Environment Secretary John Gummer's decision to direct the Local Government Commission to review council structure, according to new guidance.

However, Mr Justice Laws refused an application to halt the review while the legality of Mr Gummer's decision is tested in court. A date for legal proceedings will be decided in the new year. Derbyshire CC was due today to apply for a similar review of the revised guidance to the commission.

The county is also seeking to test the legality of Mr Gummer's decision to direct the commission to re-examine its final recommendations, which include the preservation of part of the county.

The county Labour party has succeeded in persuading Labour districts not to co-operate in the process of seeking alternative unitary council boundaries.
