Section 23 London Local Authorities Act 1991 provides London boroughs with free-standing powers to deactivate misfiring burglar alarms which have sounded continuously for more than one hour. Section 9 and sched 3 of the Noise and Statutory Nuisance Act is intended to provide similar powers to councils outside London, but has yet to be brought into force. In the meantime, Circular 9/97 urges councils to have regard to the 1982 Code of Practice on Noise from Audible Intruder Alarms, and to make best use of their powers under s79; 81(3) and sched 3 of the Environmental Protection Act 1990 to deal with it as a statutory nuisance.
