Planning consideration/neighbour amenity and enforcement

Three residents complained that there were shortcomings in the way in which the Council dealt with a planning application at a site which backs on to their properties.

The ombudsman found that the council failed to ensure that the house on a plot had been built in accordance with the approved plans.

The council agreed to commission an independent valuation to determine whether there had been any adverse effect on the value of a complainant's property resulting from the siting of the house on plot 4 of the site, and to pay any difference to the complainant, plus an additional£250 for her worry, time and trouble in pursuing the complaint.

The ombudsman found no maladministration in relation to the other two complaints.
