Newham LBC was ordered by the High Court yesterday to repay the University of East London more than £1 million in rates which had been overpaid in error over two years.

The council may also have to refund a further £1.1m in earlier overpaid rates dating back to 1984.

Mr Justice Potts did not order the second sum to be paid but he rejected Newham's claim, along with Barking and Dagenham and Waltham Forest LBCs which also funded the university, that the money should be retained.

But because Newham is obliged to act legally the sum is expected to be repaid in full. The judge said the borough did not have to repay any interest earned on the money over the nine year period.

He rejected Newham's argument that although it benefited from the extra rates, the income meant it incurred a corresponding loss in government rate support grants.
