T&G public services national secretary Jack Dromey told the Commons environment select committee: 'There needs to be transparency in the process. If a local authority decides an alternative provider is better the message to employees needs to be you need not fear.'

Mr Dromey said TUPE was crucial to the success of best value and should be resolved domestically rather than relying on Europe. 'There should be an assumption that TUPE applies. Contractors are worried that Suzen applies to them. The uncertainty should not go on any longer.'

The chair of the CBI's local authority procurement panel, Stelio Stefanou, said: 'We would recommend that the issue of TUPE is rectified as soon as possible. If someone's job transfers they should be able to transfer with it. They shouldn't fear for their jobs.'
