The Transport and General Workers' Union and the GMB, today condemned the draft guidance on the transfer of underakings and protection of employment regulations TUPE) issued by the DoE last month. The union said the guidance fails to clarify the position on TUPE and attempting to use it to discriminate against DSO bids in CCT.

Jack Dromey, National Secretary for Public Services at the TGWU, said: 'The Secretary of State is attempting to save his own face at the cost of further chaos and confusion in local government.

'It's time the DoE followed the lead of other government departments by making it clear to the local government community that TUPE applies in almost all CCT cases. Managers and employees could then get on with providing the quality services which local communities deserve.'

Mick Graham, National Secretary for Public Services at the GMB said: 'It is intolerable that the Secretary of State expects DSOs to disclose information to their competitors because TUPE might apply, and then allow them to use this information to bid on a non- TUPE basis.'
