A person who rejected a council's offer of accommodation and moved into private accommodation in the genuine but mistaken belief that the rent would be paid by housing benefit was not acting deliberately so as to render her homeless intentionally when she was unable to pay the rent, The Times (Law Report p21).

Being unable to meet the shortfall on the rent they applied to Westminster City Council for housing as being threatened with homelessness. The council refused their application on the ground that they were intentionally homeless.
