The new TUPE rights for 25 million workers are 'a strong step in the right

direction', said T&G national organiser Jack Dromey following the

publication by the government of the consultation paper on the amending of

the 20-year old Transfer of Undertakings (Protection of Employment)

Regulations 1981 (see LGCnet). 'We have won new rights for workers before,

on and after transfer,' Mr Dromey said.

'The government's proposals are not the answer to all of our prayers. They

are not a guarantee of full protection for the lifetime of a contract. They

do represent, however, welcome progress, warts and all. There is one

serious omission, and that is the failure to propose a pre-determination

procedure that would enable workers to go to an employment tribunal to sort

out who is their employer before a contract is signed. Never again should

workers be left in limbo.'

There will now be a three-month consultation process on the government's

proposals. The outcome, Mr Dromey said, must be 'a stronger and clearer

TUPE, leaving less scope for unscrupulous employers, and the extension of

TUPE to protect the pension rights of all workers, public and private.'
