UNISON has reacted to the ruling by the Employment Appeal Tribunal yesterday that a public sector cleaning service does not constitute a transfer of undertaking.

Assistant General Secretary Roger Poole said the judgement would only prolong the confusion surrounding TUPE regulations and the EC Acquired Rights Directive.

'It benefits no-one - workers, public authorities, contractors and the government all suffer from the present uncertainty,' he said.

'If necessary, the matter must be resolved by the European court itself. This decision only postpones the day when the government will have to accept that TUPE and the Directive apply to compulsory competitive tendering.' Mr Poole said.
